The short version
- EdBanz is software that schools use to run their school. The school decides who gets an account and what goes in.
- The school is responsible for its staff, students and families’ information, and we handle it on the school’s behalf.
- Use EdBanz lawfully and kindly, and never in a way that puts a child at risk.
- AI can make mistakes. Teachers review marks, and the school decides when results are released.
- Paid plans and add-ons are billed monthly and can be cancelled at any time. Paid features stay on until the end of the month already paid for.
- This summary is a guide. The full terms below are the ones that apply.
If you’re a student or a parent
- Your school gives you your EdBanz account. Use it for school, and be kind to everyone in your classes.
- Do your own work, and don’t use AI to get round your teacher’s marking.
- Keep your password and sign-in codes to yourself. If something worries you, tell your school or another adult you trust.
Who we are and these terms#
- 1.1
- EdBanz is provided by Softbanz Technology Solutions LLC, a company registered in the United States (“EdBanz”, “we”, “us”).
- 1.2
- These terms apply when a school or other education organisation (“the school”) uses EdBanz, and to everyone the school gives an account: admins, management staff, teachers, students and parents. They also apply to our website at edbanz.com.
- 1.3
- The person who signs the school up, or accepts these terms for it, confirms they are authorised to do so. If the school has signed a separate written agreement with us, that agreement applies where it differs from these terms.
- 1.4
- Our Privacy policy explains how we handle personal information. If you have a question about these terms, write to hello@edbanz.com.
What EdBanz is#
- 2.1
- EdBanz is software that schools use to run their school: administration, campuses and classes, timetables and attendance, live classes, homework and assessments, results, fees records, and communication with families.
- 2.2
- The school decides how it uses EdBanz, who gets an account and what information goes in. We provide the software; we don’t teach, employ the school’s staff or make decisions about its students.
Accounts and roles#
- 3.1
- EdBanz has accounts for school admins, management staff, teachers and teaching assistants, students and parents. Each one sees and does different things. The school decides which roles and permissions its staff have.
- 3.2
- The school creates and manages accounts for its staff, students and parents, and keeps their details accurate.
- 3.3
- Keeping accounts secure. Keep your password and sign-in codes to yourself. An account is for one person, so don’t share it. If you think someone else has used your account, tell your school and write to hello@edbanz.com.
- 3.4
- The school is responsible for what happens in its accounts, unless it happens because of a failure on our side, and for removing access when someone leaves.
The school’s responsibilities#
- 4.1
- The school is responsible for the personal information it puts in EdBanz and for having a lawful reason to use it. In data protection law, the school is the controller, and we process that information on its behalf.
- 4.2
- The school tells its staff, students and families how it uses EdBanz, and gets any consent the law requires, including a parent’s consent for a child where needed, and before using live-class recording or exam monitoring.
- 4.3
- The school is responsible for the child-safety and safeguarding rules that apply to it, including checks on its staff. Having an EdBanz account doesn’t mean a person has been checked or approved by us.
- 4.4
- If the school needs a data processing agreement with us, write to hello@edbanz.com.
Acceptable use and safety#
- 5.1
- Use EdBanz only for running the school, teaching and learning, and only in ways that are lawful and respectful to others. You must not:
- post, upload or share anything illegal, harmful, hateful, sexual, violent or bullying, or anything that puts a child at risk;
- upload files that contain malicious software, or files you don’t have the right to share;
- try to see, collect or change other people’s information, or get into accounts, schools or parts of EdBanz that aren’t yours;
- use AI features to create harmful or misleading content, or to get round a teacher’s marking;
- copy, resell or interfere with EdBanz, or test its security without our written permission;
- pretend to be someone else.
- 5.2
- Staff must teach and communicate with students in a way that suits their age.
- 5.3
- Reporting a concern. If you see something that breaks these rules, or something doesn’t feel right, tell your school, or write to hello@edbanz.com. Serious child-safety reports are treated as a priority.
- 5.4
- What we may do. We may look into reports, including by reviewing the messages, files or activity involved, and we may remove content or suspend accounts, as section 12 explains. Where the law requires it, or someone may be at risk, we may share information with the relevant authorities.
If someone is in immediate danger, contact your local emergency services first.
The school’s content and ours#
- 6.1
- The school and its users own the content they add: lessons, materials, questions, students’ work, messages and records.
- 6.2
- The school gives us permission to store, copy, process and display that content only as needed to provide EdBanz to the school and the people it shares it with, including through our service providers and when AI features are used. This permission ends when the content is deleted, except where the law requires us to keep it. Deleted content may stay in backups for a limited time before it’s overwritten.
- 6.3
- Only upload content you have the right to share.
- 6.4
- EdBanz itself, including its software, design and brand, belongs to us or to the people we license it from. You may not copy or use it except as these terms allow.
- 6.5
- If you send us ideas or feedback, we may use them to improve EdBanz without owing you anything for them.
Live classes, recordings and monitoring#
- 7.1
- Live classes run inside EdBanz through an integrated video service provided by another company. Sign-in with Google is provided by Google. When you use these parts of EdBanz, the provider’s own terms may also apply.
- 7.2
- Schools can record live classes. Recordings are kept for up to 12 months, as our Privacy policy explains. The school is responsible for telling the class before it records, for any permissions the law requires, especially for children, and for having the right to share each recording.
- 7.3
- Schools can turn on exam monitoring for assessments and other work. A school that uses it must use the information it collects only to run that work fairly.
AI features#
- 8.1
- EdBanz includes AI features, such as question and material drafts for teachers, help with checking answers and suggesting marks and feedback, hints for students, and AI assistants for staff.
- 8.2
- To provide them, the content a feature needs, such as a question or a student’s answer, is sent to an AI service provider to be processed.
- 8.3
- AI can be wrong. Treat what it produces as a suggestion, not as fact.
- 8.4
- Teachers are responsible for the questions they use and the marks they release. AI doesn’t release results; the school does. Hints are never a mark.
- 8.5
- Only put personal information into AI features when the task needs it.
Plans, trials and billing#
- 9.1
- The plans, add-ons and prices on our Pricing page, or in a quote we give the school, are the ones that apply when the school buys them. Prices are in US dollars and don’t include taxes unless we say so.
- 9.2
- Free plan and trials. Where we offer a free plan or a free trial of paid features, its limits are shown when the school starts it. When a trial ends, the paid features stop unless the school chooses to pay for them.
- 9.3
- Billing. Paid plans and add-ons are billed monthly in advance, by card, through our payment provider, and renew each month until the school cancels them.
- 9.4
- Cancelling and changing plans. The school can cancel or change a paid plan or add-on at any time. Cancelling stops the next renewal, and paid features stay on until the end of the month already paid for.
- 9.5
- Failed payments. If a payment fails, we’ll tell the school’s admins. If it isn’t paid, we may pause the paid features until it is. The school’s information isn’t deleted because of a failed payment.
- 9.6
- Refunds. Fees already paid aren’t refunded for unused time, unless we charged in error, we end the service early for a reason that isn’t the school’s fault, or the law requires a refund.
- 9.7
- Price changes. We may change prices. If we do, we’ll tell the school’s admins at least 30 days before the new price applies, and the school can cancel before then.
Other services#
- 10.1
- EdBanz may link to or work with services run by other companies, such as video meetings or the school’s own tools. We don’t control those services, and their own terms and privacy policies apply to them.
Keeping EdBanz running#
- 11.1
- We work to keep EdBanz available and working well, but we can’t promise it will always be available or free of errors.
- 11.2
- We may need to pause parts of EdBanz for maintenance, and we may change or improve features over time.
- 11.3
- If we remove something important that the school pays for, we’ll tell the school in advance.
Suspending or closing accounts#
- 12.1
- A school can close its EdBanz account at any time by writing to hello@edbanz.com from an admin’s email address. Accounts for staff, students and parents are closed by the school.
- 12.2
- We may remove content that breaks these terms. We may suspend or close an account if someone breaks these terms seriously or repeatedly, commits fraud, puts others at risk, especially children, or if the law requires it. Where it’s safe and lawful, we’ll tell the school why and give it a chance to respond.
- 12.3
- The school’s information when it leaves. Before closing, a school can ask us for a copy of its information. After the account closes, we delete or return it as agreed with the school, except where the law requires us to keep something, as our Privacy policy explains.
Responsibility and liability#
- 13.1
- Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit, and nothing affects rights the law gives you that can’t be changed by contract.
- 13.2
- We aren’t responsible for:
- the school’s teaching, decisions or records, or what its staff, students and parents do, unless our own failure caused or contributed to it;
- services run by other companies;
- losses we couldn’t reasonably have foreseen, or indirect losses such as lost profit or revenue.
- 13.3
- Where the law allows, our total responsibility to a school is limited to the amounts the school paid us for EdBanz in the 12 months before the claim.
- 13.4
- If someone makes a claim against us because content the school or its users uploaded was unlawful, or because the school misused EdBanz, the school agrees to cover the reasonable losses and costs we incur from that claim, as far as the law allows. This doesn’t apply to the extent the claim was caused by our own negligence, our breach of these terms or our misconduct. We’ll tell the school promptly about any such claim.
Changes to these terms#
- 14.1
- We may update these terms as EdBanz changes. The date at the top shows when they were last updated.
- 14.2
- If we make an important change, we’ll tell the school’s admins before it takes effect, with a short summary of what’s changed and a link to the new terms.
- 14.3
- If the school keeps using EdBanz after a change takes effect, the new terms apply. If it doesn’t agree, it can stop using EdBanz and cancel before the change takes effect. Price changes follow clause 9.7.
Problems and disputes#
- 15.1
- If something goes wrong, please contact us first at hello@edbanz.com so we can try to put it right.
- 15.2
- If the school has a separate written agreement with us, its terms on law and disputes apply.
